user agrees to indemnify and hold harmless the City of Angels and its
officers, employees and agents from and against all claims, damages, losses
and expenses including attorney’s fees, arising out of the use of the above
described facility caused in whole or in part by any negligent act or
omission of the user, or anyone directly or indirectly associated with the
use of the facility except where caused by the active negligence, sole
